I have a question that all my friends are telling me about breath tests and field sobriety tests.  I was at a friends house in the city of roseville.  We went from there and drove through Warren to pick up another friend.  We then ran through Clinton Township up Hayes to Sterling Heights and stopped at Dooleys on M-59 in Michigan.  We were driving my car and I got hammered there.  My idiot friends were also drunk so we flipped a coin as to who was going to drive home, and I lost.  I live in Shelby Township so I figured we would all crash at my house becasue there was no way I was drivng back through Roseville.  I was told I was stopped because I didn’t stop completely coming out of the Taco Bell drive through on Van Dyke.  The asshole cop pulled me out of the car in the rain and made me dance around doing these things he called field sobriety tests.  He told me I would lose my license for a year if I didn’t do them.  Is that true?  Also, he made me blow into a pbt and said I have to do that too.  Is that true?  My friends told me that I don’t.  Then he took me down to the police station and made me blow into another breathalyzer machine.  He just grabbed me by the head and tilted it downwards and said BLOW.  I Blew as hard as I could but nothing registered.  Now I think I’m screwed.  I have a paper license and it says something about appeal within 14 days.  What do I do?

    You have several issues going on, the first being you drunk driving charges, but until you retain an attorney to obtain discovery and the reelevant in-car poice videos, and the booking room videos, it’s like a doctor without an x-ray…the Michigan criminal drunk driving lawyers at Canu Torrice Law cannot make an accurate assessment of your situation.     The police station is a different story, a refusal to blow into a Datamaster/breathalyzer machine at the Police Station will potentially result in a 1 year revokation of your Michigan Driver’s License under Michigan’s Implied Consent laws (see link to http://www.alllegalmatters.com main website at http://www.alllegalmatters.com/Michigan_License_Restoration.htm for further information). You only have 14 days to file an appeal to have an Implied Consent Hearing at the Michigan Secretary of State, which in your situation would occur at the Secretary of State Super Center at the corner of Metro Parkway (16 mile) and Gratiot. However, you must specifically cite the issues you are requesting a hearing for, and you need to know the various laws in Michigan related to drunk driving and Implied Consent Hearings, or else you are just wasting your time. This means you need an Michigan driver’s license/ drunk driving attorney; you simply cannot do this yourself and expect to win. Failure to request an Implied Consent Hearing within 14 days, or if you appear at the hearing and lose, will result in an automatic 1 year loss of your Michigan Driver’s License. However, you can appeal this determination to the 16th Judicial Macomb County Circuit Court, and potentially get some driving piviledges reinstated for the duration of your suspension.     I can’t speak for anyone else, but I hired attorney Peter Torrice and I was really, really drunk when I got arrested by cops in Shelby Township for my 1st DUI. He took care of my case, only had to go in font of a Judge once, and all I got was a fine and a stupid ass 2 hour class with no probation, no testing and no jail, and I took out my neighbor’s mail box! I know people who have an ankle alcohol tether around thier foot all summer for their 1st offense.
