The short answer to your question is that without knowing more facts or reviewing the relevant police report and other discovery information, it is hard to say.

In many Michigan jurisdictions the misdemeanor charge Urinating in Public / Disorderly Conduct / Drunk and Disorderly / Disorderly Person is basically the same offense, and is a 90 day misdemeanor offense. Depending on what city your Urinating in Public / Disorderly Conduct / Disorderly Person chage is being prosecuted in it is likely being charged under a local city ordinance violation, and not state law. This is actually fotunate because under Michigan statute you could technically be charged with an indecent exposure / Criminal Sexual Conduct offense (CSC) depending on the circumstances, which (although unlikely) may subject you to potential penalies such as sex offender registration with the State of Michigan.

Whenever you have one of these kinds of cases it’s important to remember you should not just treat it as a payable offense, because it will stay on your criminal record as a misdemeanor crime conviction. You need a Michigan criminal defense attorney for any form of a Urinating in Public / Disorderly Conduct / Drunk and Disorderly / Disorderly Person ? Disorderly Conduct / Indecent Exposure charge because if you are in front of the wrong judge (and I can think of a few in the Macomb County / Oakland County / Wayne County / St. Cair County areas) the penalties can be quite severe, and in certain courts you may very well serve some time in jail or do serius probation. As crazy as that may sound, that’s the truth!
