Thank you for your question on http://www.AllLegalMatters.com to the attorneys at Canu Torrice Law. I know we spoke shortly after you made this post, but for the benefit of the readers of out Canu Torrice Law blog I will briefly address this question.

Your frustration is not unfamiliar to our attorneys. In fact, the lawyers at Canu Torrice Law represent a lot of Albanian clients, and we find them to be among the most hard working an honest people we know. Being wrongfully accused of a crime and pre-judged by police because of your race is cetainly unacceptable, and our attorneys do not tolerate that sort of treatment of our clients, I can assure you that.

The charge home invasion is a serious felony regardless of the “degree,” which determines the severity of the offense. Whether you are charged with 1st, 2nd or 3rd degree home invasion in Michigan depends on the circumstances surrounded the alleged crime. See the following link for the elements of the vaious home invasion offenses in Michigan:

Whether you are being charged with home invasion 1st degree (a 20 year felony), home invasion 2nd degree (a 15 year felony), or home invasion 3rd degree (a 5 year felony) in Michigan, and especially Macomb County, the police, prosecutors, and judges take this charge VERY seriously and often aggressively pursue jail or prision time as part of the sentence i fyou are convicted. This is because breaking into someone’s home or personal dwelling offends an American citizen’s most fundemental property and privacy rights under our Constitiution. Even our 4th Amendement protects American citizens from warrantless searches and seizures from law enforcement in the investigation of alleged crimes, and likewise our criminal laws further protect citizen’s from having another person break into their home by providing for serious punishments for this offense. In the hierarchy of criminal offenses, home invasion is just below murder and rape as far as its severity is concerned, and therefore it is one of the most serious crimes you can be charged with in Michigan or anywhere else.

If you are being investigated, interviewed, or especially charged with any allegations relating to an alleged home invasion felony offense, you need a experienced and qualified Michigan ciminal defense attorney immediately, and the attorneys at Canu Torrice Law have successfully represented multiple defendants in several very serious home invasion charges in Sterling Heights, Shelby Township, Chesterfield Township, Warren and other cities in Macomb County, Michigan just in the past few months. As you know by already retaining our office, once the attorneys at Canu Torrice Law are involved in your case, the way police and other law enforcement officials treat you is very different because of the respect our law firm commands in the legal community.

You have to understand that because of the severity of a home invasion charge, there is a tremendous amount of pressure on law enforcement to solve these types of crimes from the home owner victim, from the community in general, and especially from the investigating officer’s superiors in the polic department. Sometimes this leads to police aggressively pursuing the investigation against anyone who could potentially be a suspect, which leads to innocent people like yourself of being accused of a crime they did not commit. This may be the situation in your case. Ironically, that is where legal representation is needed just as much as the person who is actually guilty of an offense. That is where Canu Torrice Law has helped countless clients over the past several years.

While home invasion charges are very serious, in many cases there are many significant defenses available to a defendant charged with home invasion in Michigan due to the lack of evidence of the actual crime. For example, possession of a item of property in your car that was previously stolen from someone’s home is not, standing alone, evidence of a home invasion whatsoever – although many police seem to believe it is. The truth is at best, it MAY only be evidence of receiving and concealing stolen property, and in many circumstances there is no evidence of that either.

The long and short of the story is that home invasion charges in Sterling Heigfhts, and everywhere else thoughout Macomb County and the state of Michigan are among the most serious types of felony charges a person may face, and you need qualified criminal defense attorneys like the lawyers at Canu Torrice Law to defend you from potential jail and prison time. In circumstances of Albanian or other ethnic people who are not American citizens, there are serious immigration consequences that may accompany a conviction for such a charge as well, such as deportation. If this is the case, you especially need our Michigan criminal defense attorneys to help you as soon as possible.

If anyone is charged with any criminal offense Sterling Heights, Shelby Township, Chesterfield Township, Warren, St. Clair Shores, Macomb Township, or anywhere else in Michigan, especially for serious felony charges like home invasion, they should contact the criminal defense attorneys at Canu Torrice Law immediately by calling (586) 285-1700, 24 hours a day, 7 days a week.
